Prosecutors have explained their intended direction
On October 4, prosecution spokesperson Zia Alonto Adiong said discussions were continuing over whether the panel would proceed with Article III. Prosecutors said they believed the other three articles could be sufficient to seek conviction.
That explains their proposed strategy. It does not establish that the remaining evidence is sufficient; the court must assess the case.

The court spokesperson says a formal request is needed
Regie Tongol said in his October 5 briefing that prosecutors would need to ask the impeachment court for permission to drop the article. He said no formal motion had been filed at that point.
The date is important. His statement establishes the position at that briefing, and should not be stretched into a claim about a later filing that has not been verified.

The Constitution gives the Senate the sole power to try and decide impeachment cases. The prosecution presents its case, while the Senate exercises the authority to decide it.

An approved withdrawal could reduce the evidence still to be presented. Tongol described the possibility of prosecutors resting their case sooner, allowing the defense presentation to follow.
He made that conditional on the necessary request, court approval and completion of the prosecution’s remaining evidence. It should not be reported as a fixed timetable.

An announcement does not establish an acquittal
A prosecutor’s statement about what the panel intends to present is not a Senate judgment clearing the Vice President. Any court action must be described according to its actual wording and scope.
Impeachment also addresses removal from office and disqualification. The Constitution separately provides for prosecution, trial and punishment according to law for a party convicted in impeachment. An impeachment development should therefore not be casually described as settling every possible legal question.

The next reliable update is the formal request and the Senate’s response. Until that record is available, the accurate wording is that prosecutors have indicated they may stop presenting the bribery article, with court approval still requiring verification.
